Website Terms of Use

WEBSITE TERMS OF USE

These terms govern your use of twinit.com and the content on it. They are between you and Twinit Limited, a company registered in Ireland with its principal place of business at 22 Northumberland Road, Ballsbridge, Dublin 4, Ireland. By using the site you accept them. If you do not accept them, please do not use the site. 

1.  These terms and our other agreements 

These terms cover the website only. They do not govern the Twinit platform, which is provided under a Twinit Subscription License Agreement (Enterprise) between Twinit and the subscribing organisation, nor any evaluation, partnership, reseller or professional services agreement. 

If you are also a Twinit customer or partner, the agreement you have signed with us governs the platform and our services, and these terms govern your use of the website alone. Nothing on this website and nothing in these terms varies, supplements or waives any term of that agreement. Where these terms conflict with an agreement you have signed with us, that agreement prevails. 

2.  Use of the site 

You may view, download and print pages from the site for your own information and for the purpose of evaluating whether to do business with us. You may not republish, sell, rent, sub-licence or systematically extract material from the site, use it to build a competing product or service, use automated means to scrape or harvest it beyond ordinary search engine indexing, attempt to gain unauthorised access to any part of it, or use it in any way that is unlawful or that damages or interferes with it. 

3.  Our content and marks 

The site and everything on it, including text, images, video, diagrams, software and design, is owned by Twinit Limited or its licensors and is protected by intellectual property law. Twinit and our logos are our trade marks. Nothing on the site grants you any licence to use them. 

The technical documentation for the platform, where we make it available through the site, is the Documentation as defined in the Subscription License Agreement, and its use is governed by that agreement rather than by these terms. 

4.  Information on the site 

We take care with what we publish, but the site is for general information. Product descriptions, capability statements, benchmarks and case studies are illustrative, are not a specification, and do not form part of any contract unless the contract says so expressly. 

Statements about future capability are forward looking. Where the site describes features, releases or roadmap items that are not yet generally available, those statements reflect our current intention and may change. They are not a commitment, and no purchasing or compliance decision should be based on them. Capability that is contractually committed appears in the applicable agreement and the Documentation, not here. 

5.  What you send us 

If you send us an enquiry, comment, suggestion or other material through the site, you confirm you are entitled to send it and you grant us a non-exclusive, royalty-free licence to use it for the purpose for which you sent it. Where you send us feedback about our products, we may use that feedback freely to improve them. We acquire no rights in your own products, methodologies or confidential information, and you should not send us anything confidential through the site. Personal data you send us is handled in accordance with our privacy policy. 

6.  Links and third party material 

The site may link to other websites. We do not control them, we are not responsible for their content, and a link is not an endorsement. Where the site uses third party software components, those components are licensed on their own terms. 

7.  Availability, disclaimers and liability 

We provide the site free of charge and on an "as is" basis. To the fullest extent the law allows, we exclude all warranties, express or implied, including as to accuracy, completeness, fitness for a particular purpose and non-infringement, and we do not warrant that the site will be uninterrupted or error free. We may change, suspend or withdraw the site or any part of it at any time. 

To the fullest extent the law allows, we are not liable for any loss of profit, revenue, business, goodwill, data or anticipated saving, or for any indirect or consequential loss, arising from your use of the site or from reliance on anything on it. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. 

8.  Privacy and cookies 

Our privacy policy at twinit.com/privacy-policy explains how we handle personal data, and our cookie settings let you control the cookies that are not strictly necessary. 

9.  Changes, law and contact 

We may update these terms from time to time, and the version published on the site applies to your use of it. These terms and any dispute arising from them are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction.
